Overview
Welcome to minte.ca (the “Site”). The Site is operated by Cosmetology by Minte Sidhu Corp., carrying on business as Minte Medical Aesthetics (“Minte,” “we,” “us” or “our”). Shopify provides the ecommerce platform that allows us to offer products and related online services.
By accessing the Site, creating an account or placing an order, you agree to these Terms of Service and the policies referenced in them. If you do not agree, please do not use the Site.
Nothing in these Terms excludes or limits any right or remedy that cannot lawfully be excluded or limited under applicable consumer-protection law.
Eligibility and accounts
You must have reached the age of majority in your province or territory of residence to make a purchase through the Site.
You agree to provide accurate, current and complete information. You are responsible for protecting your account credentials and for activity completed through your account.
Product information
We make reasonable efforts to present accurate product descriptions, sizes, ingredients, prices and images. Packaging, labelling, colour and appearance may vary because of manufacturer updates, Canadian packaging requirements, screen settings or photography.
Product information on this Site is provided for general informational purposes and is not medical advice. Skincare products may not be appropriate for every person. Always follow the product label and directions provided by the manufacturer. Contact a qualified healthcare professional if you have questions about your health, medications, pregnancy or breastfeeding status, allergies, medical conditions or suitability for a product.
Ingredients and formulations may change. Please review the product packaging before use, particularly if you have allergies or sensitivities.
Orders and availability
Submitting an order is an offer to purchase. An order is accepted once payment has been successfully processed and we confirm the order. We may decline or cancel an order because of inventory availability, pricing or listing errors, suspected fraud, purchasing limits, delivery restrictions or other reasonable operational concerns.
If we cancel an order after payment has been processed, the applicable amount will be refunded to the original payment method.
Products are intended for personal use and not for unauthorized resale or export. We may limit quantities where reasonably necessary.
Prices, taxes and payment
Unless stated otherwise, prices are displayed in Canadian dollars and applicable taxes and delivery charges are added at checkout.
Prices, promotions and availability may change without notice. The price displayed when an order is submitted will apply, subject to correction of an obvious error. You agree that you are authorized to use the payment method submitted with your order.
Shipping, delivery and pickup
Shipping, Winnipeg delivery and clinic pickup are governed by our Shipping, Winnipeg Delivery & Clinic Pickup Policy.
Processing and transit times are estimates rather than guarantees. Please ensure that your delivery address and contact information are complete and accurate before submitting your order.
Returns and order issues
Returns, damaged or defective products, missing items, incorrect orders, reactions and other order concerns are governed by our Returns & Order Issues Policy.
Please inspect your order promptly after receiving it and contact us as soon as possible if there is a concern. Our policies do not limit rights or remedies available under applicable law.
Promotions and gift cards
Promotions, discount codes, gifts with purchase and other offers may be subject to separate conditions. Unless expressly stated otherwise, offers cannot be combined, applied retroactively or redeemed for cash.
Gift cards are subject to the conditions disclosed at purchase and applicable law. Lost, stolen or unauthorized use of gift cards should be reported promptly.
Clinical services
Purchasing or viewing a product through the Site does not create a healthcare-provider relationship. Clinical consultations, treatments and appointments are separate from online retail purchases and are subject to clinical assessment, informed consent and applicable clinic policies.
Information submitted through regular website forms or email should not be used for urgent medical concerns. If you are experiencing a medical emergency, contact the appropriate emergency service.
Intellectual property
The Site and its original content, design, branding, graphics and other materials are owned by or licensed to Minte and are protected by applicable intellectual-property laws.
You may use the Site for personal, non-commercial purposes. You may not reproduce, modify, distribute, sell or commercially exploit Site content without prior written permission from the applicable rights holder.
Third-party product names, trademarks, photographs and materials remain the property of their respective owners.
Third-party services and links
The Site may use or link to services operated by third parties, including Shopify, payment providers, delivery providers and social-media platforms. Those services may be governed by their own terms and privacy policies.
We are not responsible for the content, availability or privacy practices of third-party websites that we do not control.
Acceptable use
You must not use the Site to:
- Violate applicable law or the rights of another person
- Submit false, fraudulent or misleading information
- Interfere with the security or operation of the Site
- Transmit malicious code or attempt unauthorized access
- Collect another person’s information without authorization
- Harass, threaten or abuse another person
- Use Site content for unauthorized commercial purposes
We may restrict access to the Site where reasonably necessary to protect customers, staff, the business or the security of the Site.
Privacy
Personal information collected through the Site is handled in accordance with our Privacy Policy. Certain information may also be processed by Shopify and other service providers as described in that policy.
Availability and limitation of liability
We make reasonable efforts to keep the Site accurate, secure and available, but cannot guarantee uninterrupted or error-free access.
To the extent permitted by law, Minte is not responsible for indirect, incidental or consequential loss arising from the use or unavailability of the Site. Nothing in these Terms excludes liability or limits a right or remedy where doing so is prohibited by law.
Changes to the Site or these Terms
We may update the Site, these Terms or the products and services offered through the Site. The current version will be posted here with an updated revision date. Changes will apply prospectively unless applicable law requires otherwise.
Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply.
Governing law
These Terms are governed by the laws of Manitoba and the federal laws of Canada applicable in Manitoba, subject to any mandatory consumer rights that apply in the customer’s jurisdiction.
